Illegal alien's injury lawsuit could spark investigation



In a case that could bolster a long-running federal grand jury probe into Northeast Florida's construction industry, an undocumented Mexican worker permanently paralyzed on a job site is filing suit today in Jacksonville against homebuilding giant D.R. Horton.
Jorge Gomez, 23, was injured Nov. 11 when a large beam fell on him and broke his neck at a D.R. Horton site in a Julington Creek subdivision, according to the lawsuit. The accident left him a quadriplegic.

As an illegal alien, Gomez has no workers compensation insurance and has run up $500,000 in medical bills at Jacksonville's Memorial Hospital, which continues to treat him, said Gomez's attorney, Gary Pajcic.
Julie Humphress, marketing director for D.R. Horton-Jacksonville, said the company has no record of Gomez, who was working for a framing subcontractor on the site. She said the homebuilder does not employ illegal aliens.
"We have no knowledge of this person. We know that this person was never employed by D.R. Horton," Humphress said. "We want everyone to be safe on our job sites."
Pajcic said that's part of the problem. "They should have a record. He should probably be in rehabilitation by now, but instead he's lying flat on his back in a hospital bed because D.R. Horton had no record of him," Pajcic said. "Jorge's catastrophic injury shows how these illegal business practices can have tragic human consequences. ... Maybe this lawsuit will lead to complete discovery of this problem."
The lawsuit comes as a federal grand jury in Jacksonville continues to investigate the widespread use of illegal workers and the laundering of their paychecks to dodge workers compensation premiums and taxes in the homebuilding industry. The practice hurts honest contractors because they can't build homes as inexpensively and legitimate subcontractors, who can't compete for work given to illegal aliens at a fraction of the cost, attorneys said.
No indictments have been returned in the five-year probe but one accused participant, former Neptune Beach accountant Robert West, recently went to state prison for paying to have a workers compensation investigator killed. His plan was stopped by state investigators.

U.S. Attorney's Office spokesman Steve Cole declined comment on the lawsuit.
Attorney Curtis Fallgatter, who has several clients under investigation by the grand jury, said evidence gathered in the suit could bring out facts about illegal workers on construction job sites and how they are paid. But federal prosecutors would still have to prove D.R. Horton and other contractors knowingly hired illegal aliens, a much higher standard of proof, Fallgatter said.
"I'd be a little surprised if it came to light that the Hortons were hiring subcontractors to hire subcontractors to hire illegal aliens," Fallgatter said.
Gomez entered the United States illegally in March but had since applied for a green card allowing him to work legally, Pajcic said. He came to Jacksonville to work construction and was earning about $400 a week when the accident occurred.
Gomez and a crew of three other illegal Mexican workers were lifting a large beam when it fell on him, according to the lawsuit. With no telephone to call for help, the other workers put him in a van and drove him to Memorial, Pajcic said.
"They did not provide any training to these workers. They did not provide any equipment, such as a scaffold or even a crane," Pajcic said. "There were no helmets provided to these workers, which might have prevented this injury."
From his hospital bed at Memorial, Gomez, unable to speak, nodded in agreement as Pajcic explained the lawsuit to him Monday afternoon. Gomez's parents, who got permission to come from Mexico to visit him, wept as they described a happy, friendly son who planned to return to Mexico and marry his fiancee of seven years this December.
Pajcic said Gomez also has filed a workers compensation claim against the framer, FCF Inc. of Jacksonville. Officials there couldn't be reached for comment, but attorneys said they expect the claim to be rejected.
Humphress said D.R. Horton is "meticulous" about making sure its subcontractors comply with workers compensation rules and have liability insurance. But subcontractors frequently farm out work to other subcontractors, and the company can't keep track of all of those, she said.
But the suit contends the ultimate responsibility lies with D.R. Horton.
"When a tragic injury like Jorge's occurs, D.R. Horton should not be able to hide behind sham subcontractors and cover its eyes and pretend to see and hear no evil," Pajcic said. "As the owner and contractor for this home, D.R. Horton ... has the duty under Florida law to maintain a safe place to work. It woefully breached that duty in Mr. Gomez's case."

Nykerion Nealon, 17, was arrested early Friday after gunning down Ahmed al-Jumaili with an assault rifle March 4, police said.

A Texas teen has been arrested for fatally shooting an Iraqi refugee watching his first-ever snowfall, police said.
Nykerion Nealon, 17, was arrested early Friday after gunning down Ahmed al-Jumaili outside his Dallas apartment complex March 4, Maj. Jeff Cotner told reporters alongside the victim's father-in-law Friday.
Al-Jumaili was shot in front of his wife and brother, three weeks after fleeing Iraq to be in a safer place and reunite with his wife, who had moved to America a year earlier.
Nealon, who went by the nickname Kaca, did not know al-Jumaili and shot him while seeking revenge, Cotner said. Someone reportedly shot at his girlfriend's apartment in a neighboring complex, making Nealon round up three buddies to look for the suspect, a witness told police. They went to Nealon's apartment to get his assault rifle and then headed to Al-Jumaili's apartment complex.
The black negro male saw al-Jumaili taking pictures of the snow and raised his rifle, one of his friends told police. The friend took cover under bushes and heard shots ring out, he said. 
Al-Jumaili ran back to his apartment as Nealon followed him with his eyes, continually aiming his rifle and firing at him, Cotner said. Al-Jumaili was shot in the chest.
The Iraqi collapsed in the breezeway of his apartment building. He died in the hospital the next day.

President Obama’s Department of Homeland Security caught then released 68,000 aliens who had previously been convicted of a crime, a new report from the Center for Immigration Studies shows.

The report, provided to Breitbart News ahead of its late Sunday evening release, reviews internal Immigration and Customs Enforcement (ICE) metrics to conclude that the Obama administration released 35 percent–or 68,000–convicted criminal aliens back into the U.S. general population when they could have been deported. “The criminal alien releases typically occur without formal notice to local law enforcement agencies and victims,” CIS’s Jessica Vaughan, the report’s author, added.
By “criminal,” ICE means people who have been convicted of a misdemeanor or felony that is not a traffic violation. For instance, traffic violations like Driving Under the Influence of Alcohol or even vehicular manslaughter do not count toward this description of “criminal alien.” As for the definition of “alien,” ICE mostly means illegal aliens, though some are legal aliens when they are considered deportable legal aliens–which is possible for legal immigrants who have committed a serious crime, like a felony.
The documents also show ICE only deported a small fraction of the aliens they encountered overall.
“In 2013, ICE targeted only 195,000, or 25 percent, out of 722,000 potentially deportable aliens they encountered,” CIS’s Vaughan wrote. “Most of these aliens came to ICE’s attention after incarceration for a local arrest.”
This report comes out on the heels of a report from the office of Sen. Jeff Sessions (R-AL) last week which found that only .08 percent of the aliens deported in 2013 were not serial immigration law violators or convicted of serious crimes.
In response to these findings from CIS that follow up on his office’s report last week, Sessions said immigration law in America has essentially ceased to exist.
“The preponderance of the evidence demonstrates that immigration enforcement in America has collapsed,” Sessions said. “Even those with criminal convictions are being released. DHS is a department in crisis. Secretary [Jeh] Johnson must reject the President’s demands to weaken enforcement further and tell him that his duty, and his officers’ duty, is to enforce the law – not break it. As Homeland Secretary, Mr. Johnson is tasked with ensuring the public safety and the rule of law. But Secretary Johnson is not meeting these duties.”
The CIS report also contains a breakdown per city of percentages of criminal aliens who were released back into the population. San Antonio’s 79 percent is the highest, where ICE encountered 36,228 criminal aliens and released 28,680 back into the general population in 2013. New York City’s 71 percent is next, where ICE agents encountered 7,571 criminal aliens and released 5,391 of them. Washington, D.C. follows that, with ICE agents encountering 8,688 criminal aliens and releasing 64 percent, or 5,558, of them into the public. Other cities with high percentages include Salt Lake City, Houston, Phoenix, Los Angeles, Atlanta, Newark, and Buffalo. Notably, many of these cities are not in border states, which means visa overstays and illegal aliens who crossed the border but migrated further inward are as much a problem as the actual U.S.-Mexico border in terms of stopping the flow and enforcing the law.
“These findings raise further alarm over the Obama administration’s pending review of deportation practices, which reportedly may further expand the administration’s abuse of ‘prosecutorial discretion,'” CIS’s Vaughan wrote. “Interior enforcement activity has already declined 40 percent since the imposition of “prosecutorial discretion” policies in 2011. Rather than accelerating this decline, there is an urgent need to review and reverse the public safety and fiscal harm cause by the president’s policies.”
Sessions echoed Vaughan’s concerns, saying the lack of enforcement for immigration laws further hurts the ability of American citizens to obtain employment.
“American citizens have a legal and moral right to the protections our immigration laws afford – at the border, the interior and the workplace,” Sessions said. “The administration has stripped these protections and adopted a government policy that encourages new arrivals to enter illegally or overstay visas by advertising immunity from future enforcement.  Comments from top Administration officials, such as Attorney General Holder’s claim that amnesty is a civil right, or Vice President Biden’s claim that those here illegally are all US citizens (apparently including someone whose visa expired yesterday), demonstrate the administration’s increasing belief in an open borders policy the American public has always rejected.”
