children who were brought to this country at a young age, applying for college is the first time they’re confronted with the reality of their legal status — or lack thereof. And even though around 20 states offer in-state tuition to certain undocumented students, many of those who qualify for such benefits still wind up paying more than they should.

Now, thanks to the persistence of one campus group, at least

 150 undocumented students will get back the thousands of tuition dollars they unwittingly overpaid.

The City University of New York announced this week that it will refund fees to immigrant students who paid out-of-state tuition despite qualifying for the in-state rate. The decision came after the CUNY DREAMers group (kids affected by the DREAM Act) alerted school officials to the fact that many of the school’s immigrant students were paying about $4,000 a semester more than they needed to.

“I was going to quit school. It was too expensive,” Freddy Vicuna, a computer engineering student at CUNY and

 65,000 undocumented immigrant kids graduate from high school in the U.S. each year, but only an estimated 5 to 10 percent go to college. Comparatively, the Bureau of Labor Statistics found that of the 3 million or so youths who graduated from high school in 2013, about 65.9 percent, or 2 million of them, went to college.
One of the factors contributing to the huge disparity between undocumented students and everyone else is the high cost of higher education paired with a lack of information about what kind of financial aid is actually available to undocumented students.

As the Educational Empowerment Program coordinator with United We Dream, a national immigrant youth-led advocacy group, Bohorquez works to close the communication gap between students, administrators, and students. She also knows firsthand how valuable that communication is — and how discouraging its absence can be.

Bohorquez, now 27, immigrated from Mexico to the small town of Brewster, Wash., when she was 4 years old. In 2003, Washington rewrote its definition of "resident" to include anyone who’d lived in the state for three years prior to receiving their high school diploma or GED there, regardless of immigration status. But by the time Bohorquez started the college application process a few years later, the fact that undocumented students were now eligible for in-state tuition was still not well known. In fact, she said, admissions officers told her she was not eligible for any financial aid.

“It’s true, I wasn’t eligible for federal aid, but [in-state tuition] was not something I ever found out about until I enrolled in the school and took it upon myself to look into it,” Bohorquez told Yahoo News.

Fortunately for her, Bohorquez said she had a supportive high school counselor who was aware of her immigration status and helped her find local scholarships for families, like hers, that worked in agriculture. Out of the 80 she applied for, Bohorquez says she received about 15, adding up to around $35,000 — “a buffer” that allowed her to take a risk and enroll at Western Washington University, where she eventually found out about in-state tuition.

Not all undocumented students are that lucky.

“A lot of students are let down and turned away,” she said, explaining that a perception that they can’t afford tuition often encourages students to go to a community college from which its hard to transfer or, worse, deters them from applying for continuing education at all.

“What I’ve learned through my work and my own experience is that you have to do a lot of self-advocacy because there is a lack of educators supporting these students,” Bohorquez said. “My goal is for students to own their role, but for educators to own their role as well.”

Thanks to a 1982 Supreme Court decision, all kids in the U.S. are eligible for free public education from kindergarten through 12th grade. That ruling was specifically intended to prevent the creation of an uneducated second class. But in 1996 Congress passed the Illegal Immigration Reform and Immigration Responsibility Act, an expansive crackdown that, among its provisions, imposed tighter restrictions on in-state tuition, prohibiting state colleges and universities from offering in-state tuition to undocumented students without offering the same discounted rates to all U.S. citizens.
College was essentially eliminated as an option for a population of high school graduates who otherwise would have continued their education. States soon started taking the matter into their own hands.
“Over the last couple of years we’ve seen more states passing bills around allowing undocumented students access to in-state tuition, and even more so seeing states offering financial aid to undocumented students,” said Suzanne Hultin, a policy specialist for the National Conference of State Legislatures’ (NCSL) Education Project in Denver. The NCSL tracks in-state tuition programs for undocumented students.

“I think a lot of it comes down to economic development and jobs and realizing that in order for people to qualify for the majority of jobs they’re going to need some sort of post-high school credential,” Hultin told Yahoo News

Kitzhaber has a God Complex- he overturned voter approved laws at least twice- the NO Drivers licences for illegals ( which is why you see so many mexicans with Washington Plates in Columbia county or California plates) and the death penalty He gave free medical to pregnant illegals and children but Oregonians had to pay for their medical. I am so glad he is gone . Not to mention free tuition to college for illegals in Oregon,but legal citizens have to take out loans and go into debt.


Gov. John Kitzhaber's administration is refusing to release more than 150 emails dealing with internal advice the governor received prior to his controversial decision to grant a reprieve for condemned killer Gary Haugen and to ban capital punishment while he's in office.


The action came last week in response to a public records request filed by the Statesman Journal.


-Kitzhaber's ban on capital punishment effectively nullified Oregon voters reinstatement of the death penalty in 1984. Accordingly, Oregonians have a right to know, in much greater

detail than Kitzhaber has revealed to date, how and when he decided to take his extraordinary stand against the death penalty. The withheld emails could shed light on his decision-making process.


-The public interest served by disclosing the emails trumps the governor's office stated desire to keep the messages secret in order for his advisors "to give uninhibited advice" to Kitzhaber.


-Keeping the emails under wraps runs counter to the governor's call for "all Oregonians" to engage in a "long overdue debate" about capital punishment.
Debate opens


The Democratic governor threw open the door for such a debate on Nov. 22. Speaking at a Capitol news conference, Kitzhaber slammed Oregon's capital-punishment system, describing it as "broken" and "a perversion of justice."


At the same time, the governor stunned many Oregonians — pleasing some, angering others — when he announced that he won't allow any executions to happen under his watch. In issuing a temporary reprieve for Haugen, Kitzhaber unilaterally canceled the scheduled Dec. 6 execution of the 49-year-old, twice-convicted killer, who dropped his appeals and repeatedly stated his desire to be executed.


A former emergency-room physician, Kitzhaber allowed two executions to take place during his first term in the 1990s, those of serial killer Douglas Wright in 1996 and Salem double killer Harry Moore in 1997.

Barbara Arellano. "I am so frustrated with the people against the death penalty now asking you to stop his execution."Arellano noted that she lived in the same home with Haugen in the 1970s and now corresponds with him by mail and speaks to him several times a week by telephone.

sounds crazy to beg you to let my brother die, but I understand why he wants this and will be in total respect of his wishes," she wrote."I know where his head is and this needs to just be done with."

Ellis had to help his 80-year-old mother to a courtroom table Wednesday afternoon as she listened to the reasons she may soon have to leave her home of 25 years: A shed they had built with permission years ago spills over their property line and they aren’t parking where they should.

“The reason for this eviction is because they are refusing to remove from that space, refusing to stop parking in that space, refusing to comply,” attorney Craig McReary said in Cowlitz Superior Court.
Though a judge denied the initial request to evict Yohnda Ellis, she’ll be back in court soon for a trial.
“And we’re not the only ones who will be coming through here,” Butch Ellis said.
A handful of residents say it’s not so sunny at the Sunny Meadows Mobile Home Park, where a wave of evictions has followed a new park manager’s first year at the West Longview community.
Yohnda Ellis is among those being told to leave the gated trailer park on Ocean Beach Highway.
“It’s not right to make an elderly person start over again like this,” she said Monday from a neighbor’s home where a dozen people gathered to join her in voicing concerns.
“(The park manager) is raising all sorts of havoc with people’s lives,” said 61-year-old Butch Ellis.
A former bartender, Butch Ellis is disabled and lives with his mother in the mobile home she’s owned for decades.
They said in the 25 years of residing at the park under multiple managers, they have never had a problem until now.
Sunny Meadows park manager Diana O’Sullivan has presented the Ellises with three “15-day notice to comply or vacate” orders since October.
“By occupying the area north of your space with vehicles, a shed, non-permitted activities and other personal property, you are in violation of the terms of your rules and regulations,” read the notices.
O’Sullivan did not return phone calls seeking comment Thursday.
Next to Yohnda Ellis’ neatly kept blue home is a grassy field that serves as a common area. This is the space her 12-by-18-foot storage shed is apparently encroaching on.
Moving the shed — beyond the question of where it would go — just isn’t possible, Butch Ellis said.
“It would kill us,” he said, adding that he and his mother live on fixed Social Security incomes.
Previous managers had allowed him to build and maintain the shed, and he wasn’t aware that it wasn’t on his mother’s rented space.
McReary, O’Sullivan’s lawyer, said that a verbal agreement isn’t a permanent agreement.
“That act produces, at best, a license. The park reserves the right to revoke the license at any time,” McReary said in court Wednesday. “What has happened with these 15-day notices is that the license has been revoked.”
Other residents have been given similar notices for parking violations or driving vehicles that were deemed too loud, Butch Ellis said. He accused O’Sullivan of fabricating charges to spur additional evictions.
Judge Michael Evans on Wednesday said the two sides are “at loggerheads” and mediation or a trial would be needed to resolve the matter.
The Ellises will find out their court date next week.
For Yohnda and Butch Ellis, it’s a fight to save their home — and they’re fighting to the death.
“She intends to die here, I intend to die here,” Butch Ellis said.

(CNN)New York City public schools will now observe two Muslim holidays, officials announced Wednesday, making the district -- the nation's biggest -- one of the few to put Islamic holy days on its calendar.


Under the change announced by New York Mayor Bill de Blasio and city Schools Chancellor Carmen Farina, there will be no class for Eid al-Adha, also known as the Festival of Sacrifice, starting next September 24. Another Muslim holiday, Eid al-Fitr -- a festival marking the end of the holy month of Ramadan -- will become a holiday for those in summer school starting in 2016.


"This is a common-sense change," de Blasio said Wednesday, "and one that recognizes our growing Muslim community and honors its contributions to our city."


The decision affects some 1 million students in New York City.
While it's not known exactly how many of them are Muslim, City Council Speaker Melissa Mark-Viverito said that almost 1 million of the more than 8 million people in the city's five boroughs practice Islam and a 2009 Columbia University study found that roughly 10% of New York City public school students are Muslim.


The move isn't a surprise, given de Blasio's campaign pledge to alter the school calendar with Muslim families in mind.


"Muslim students and their families who observ shouldn't have to choose between an instructional day and their religious obligations," said Farina. "This new addition will also enable a teachable moment in the classroom for our students to learn about religious tolerance and the societal contributions of various cultures."


Linda Sarsour, executive director of the Arab American Association of New York and the parent of three public school students, said a plan in which students wouldn't have to choose between education and faith "a win for our children and for future generations in this country."

New York City joins school districts in other states, including New Jersey, Massachusetts and Vermont, that similarly observe Muslim holidays, according to a news release from Farina's office.


And Eid al-Fitr and Eid al-Adha join other religious holidays already on New York's public school calendar. In addition to holidays like Easter that always fall on a weekend, students already have Christian holidays such as Good Friday and Christmas off, as well as the Jewish holidays of Rosh Hashanah and Yom Kippur.
